TERMS & CONDITIONS

1. BOOKING & PAYMENT
A non-refundable booking fee is required to secure your session date and time.
• Standard sessions (Newborn, Family, Communion, Christening, etc.): €50 booking fee
• Mini Sessions: €30 booking fee
The booking fee must be paid within 24 hours of receiving payment details. If payment is not received within this time, the slot may be released.
The booking fee confirms and reserves the time slot and is deducted from the final session price.
The remaining balance is due on the day of the session.
2. CANCELLATION & RESCHEDULING
The booking fee is non-refundable.
If the client cancels the session or does not attend, the booking fee will be lost.
Only one reschedule is allowed due to illness or unforeseen circumstances, provided it takes place within 4 weeks of the original session date.
After 4 weeks, a new booking fee will be required.
3. PHOTOGRAPHY SESSION
The client agrees to arrive on time for the session.
The photographer cannot guarantee specific poses or outcomes, as sessions are baby- and child-led where applicable.
The photographer reserves the right to end or reschedule a session in the event of unforeseen circumstances.
4. IMAGES, EDITING & DELIVERY
All images are selected and edited by Magic Moment ZK Photography.
RAW files are not provided.
The photographer retains full artistic control over editing and final image selection.
5. GALLERY & DELIVERY TIMES
An online gallery is delivered approximately 5 days after the session.
Final edited images are delivered approximately 4 weeks after client selection.
The online selection gallery is available for 1 month.
Download access is available for 2 weeks.
Extended access may incur additional fees.
It is the client’s responsibility to download and back up images within the given timeframe.
6. COPYRIGHT & USAGE
Copyright remains with Magic Moment ZK Photography.
Clients receive a personal, non-transferable licence for private use only.
You are welcome to share your photos on personal social media.
Images may not be edited, filtered, or used commercially without permission.
7. PRINTING & PRODUCTS
Clients may print their purchased images for personal use.
Please note that colour and print quality may vary when using third-party printing labs.
Images may be shared with trusted professional printing suppliers solely for the purpose of fulfilling client orders (prints, canvases, albums, etc.).
8. PUBLICATION CONSENT
Images will only be used for marketing, portfolio, website, social media or promotional purposes if the client or legal guardian has given explicit consent.
Consent may be withdrawn at any time for future use.
9. LIABILITY
The photographer is not liable for circumstances beyond her control (including illness, accidents, equipment failure or force majeure). Only if the photographer cancels the session for any reason will a full refund of all payments made be issued.
10. ACCEPTANCE
By booking a session with Magic Moment ZK Photography, the client confirms they have read, understood and accepted these Terms & Conditions.
11. GIFT EXPERIENCE / PRE-BOOKED SESSIONS
Gift sessions are pre-booked photography sessions and not gift vouchers.
All session details including date, time, and session type are agreed at the time of booking.
Only one reschedule is permitted with at least 48 hours’ notice. The new session date must take place within 4 weeks of the original booking date. After this period, a new booking fee may be required.
Gift sessions are non-refundable and non-transferable. Failure to attend the session will result in the session being forfeited.
Gift sessions follow the same Terms & Conditions as standard bookings.

1. DATA CONTROLLER
Magic Moment ZK Photography respects your privacy and is committed to protecting your personal data.
2. WHAT INFORMATION I COLLECT
• Name (provided during enquiry or booking)
• Phone number (optional)
• Email address (when you contact me or when accessing your online gallery to view or download images)
• Information provided via email, phone, social media or booking enquiry
• Signed booking contract and consent forms completed in studio
• Photographs created during your session
3. HOW YOUR INFORMATION IS USED
• To respond to enquiries and communicate with clients
• To manage bookings and appointments
• To deliver your secure online gallery and photographs
• To provide access to your private gallery for viewing, selecting and downloading images
• To process payments and manage business records
We process your personal data on the basis of contract, consent and legitimate interest.
4. PRINT LABS & THIRD PARTIES
Photographs may be shared with trusted professional printing suppliers only when required to fulfil client orders for products such as canvases, albums, or prints larger than A3.
5. IMAGE PUBLICATION
Your photographs will never be published without your permission. Publication on my website, social media, or promotional materials only takes place when you have provided consent.
6. DATA RETENTION
Photographs are stored for a minimum of 1 year from the session date.
Personal data is kept only as long as necessary for business and legal purposes.
7. YOUR RIGHTS
You have the right to:
Access your personal data
Request correction of inaccurate information
Request deletion of your data where applicable
Withdraw consent at any time
